Most of us remember Tom Cruise jumping up and down on Oprah Winfrey’s couch, declaring his love for Katie Holmes. He was so in love that he simply couldn’t sit still, but he most likely won’t be repeating that episode in the near future — or at least with the same emotions — after Holmes abruptly filed for divorce.
The divorce filing has indications that this will not be the most amicable divorce in Hollywood. It was reported that not only is Holmes seeking a divorce, but that she also wants sole custody of their daughter, Suri. In her child custody request, she wants not only primary residential custody but sole decision-making authority as well.
Seeking sole custody is not always the easiest road. Evidence must show that it is in the best interests of the child and that the other parent is not fit in some way. Although Holmes filed for divorce in New York, there are indications that if Cruise wants to fight the request he could seek to move the proceedings to California where it may be a more difficult road for Holmes.
Both Cruise and Holmes practice the religion of Scientology. However, Cruise is much more devout in every aspect of the religion than Holmes. This may be the basis that Holmes will use in her argument. It is not the religion itself, but the tenet of opposition to modern medicine including medication, psychiatry and psychology amongst others. It was reported that Holmes may use this to argue that Cruise’s devout beliefs would not be in the best interest of the child.
It is unclear what will occur in the couple’s divorce and custody proceedings, but professionals suggest that the Scientology issue may be simply scratching the surface of deeper problems between the pair.
